        • you have the right to grant us the license set out in this Agreement; and

THESE LIMITATIONS SHALL APPLY REGARDLESS OF THE FORM OR CAUSE OF ACTION OR THE ALLEGED BASIS OF THE CLAIM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES AND EVEN IF THE REMEDIES OTHERWISE PROVIDED UNDER THIS AGREEMENT (AT LAW OR IN EQUITY OR OTHERWISE) FAIL OF THEIR ESSENTIAL PURPOSE.

YOU AND GGMI AGREE THAT THE WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY IN THIS AGREEMENT ARE MATERIAL, BARGAINED-FOR BASES OF THIS AGREEMENT, AND THAT THEY HAVE BEEN TAKEN INTO ACCOUNT IN DETERMINING THE CONSIDERATION TO BE GIVEN BY EACH PARTY UNDER THIS AGREEMENT AND IN THE DECISION BY EACH PARTY TO ENTER INTO THIS AGREEMENT. YOU AND GGMI AGREE THAT THE WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY IN THESE TERMS OF USE ARE FAIR AND REASONABLE.
    3. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT YOUR SOLE REMEDY FOR ANY BREACH OF THIS AGREEMENT WILL BE THE SUBSTITUTION OR REPLACEMENT OF ALL OR PART OF THE SITE THAT GIVES RISE TO DAMAGES INCURRED BY YOU. YOU AGREE THAT THIS LIMITATION OF LIABILITY WILL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.   13. Minors.
    The consent of a parent, guardian or educational supervisor shall be required before a Minor can use the Site. Use of any part of the Site is confirmation that the person is an adult or a Minor who has received permission from a parent, guardian or educational supervisor to use the Site. A parent, guardian or educational supervisor will be responsible for any activities of a Minor on the Site regardless of whether the Minor has received permission from the parent, guardian or educational supervisor to use the Site.
