- Nature of User Material. - User Representations and Warranties. Each time you Submit User Material you represent and warrant that:
- you have the right to Submit the User Material to this Site, which means:
- you are the author of the User Material, or
- the User Material is not protected by copyright law, or
- you have express permission from the copyright owner to post the User Material on this Site; and
- you have the right to grant us the license set out in this Agreement; and
- the User Material you Submit does not violate this Agreement.
- you have the right to Submit the User Material to this Site, which means:
- License Grant to Us. You grant GGMI, its affiliates, and related entities a royalty-free, perpetual, unlimited, irrevocable, non-exclusive worldwide license for all possible rights to use, copy, modify, display, archive, store, publish, transmit, perform, distribute, reproduce and create derivative works from all any User Material you provide to GGMI and the Site in any form, media, software or technology of any kind now existing or developed in the future, without compensation to you and subject to the terms of our Privacy Statement. Except as expressly provided in this Section 8, User Material shall not be subject to any obligation on our part, including without limitation any obligation of confidentiality, and we shall not be liable for any use or disclosure (including publication in any medium) of any User Material.

YOU ASSUME THE ENTIRE RISK AS TO THE USE OF THIS SITE AND THE CONTENT, PRODUCTS, SERVICES, USER MATERIALS, SUBMISSIONS, AND SERVICES PROVIDED ON THIS SITE. - Your Representations & Warranties.
You represent and warrant that you are not under the age of 13, that you possess the legal right and ability to enter into this Agreement on your own behalf or on behalf of any person for whom you are acting as agent, that you are authorized to use any password required for this Site, and that your conduct and all User Material that you Submit to us complies with the terms of this Agreement. - LIMITATION OF LIABILITY -- NO INCIDENTAL, CONSEQUENTIAL, OR OTHER SPECIAL DAMAGES.
- TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT WE WILL NOT BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, SPECIAL, OR OTHER DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, AND THE LIKE, ARISING OUT OF OR RELATING IN ANY MANNER TO THIS AGREEMENT OR YOUR ACCESS TO, USE OF, INABILITY TO USE, PERFORMANCE OF, CONTENT OF, PRODUCTS OR SERVICES PROVIDED ON OR IN CONNECTION WITH THIS SITE, AS WELL AS ANY THIRD PARTY WEBSITE PAGES OR ADDITIONAL WEBSITES LINKED TO THIS SITE. THESE LIMITATIONS SHALL APPLY REGARDLESS OF THE FORM OR CAUSE OF ACTION OR THE ALLEGED BASIS OF THE CLAIM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES AND EVEN IF THE REMEDIES OTHERWISE PROVIDED UNDER THIS AGREEMENT (AT LAW OR IN EQUITY OR OTHERWISE) FAIL OF THEIR ESSENTIAL PURPOSE.
- YOU AND GGMI AGREE THAT THE WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY IN THIS AGREEMENT ARE MATERIAL, BARGAINED-FOR BASES OF THIS AGREEMENT, AND THAT THEY HAVE BEEN TAKEN INTO ACCOUNT IN DETERMINING THE CONSIDERATION TO BE GIVEN BY EACH PARTY UNDER THIS AGREEMENT AND IN THE DECISION BY EACH PARTY TO ENTER INTO THIS AGREEMENT. YOU AND GGMI AGREE THAT THE WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY IN THESE TERMS OF USE ARE FAIR AND REASONABLE.
- TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT YOUR SOLE REMEDY FOR ANY BREACH OF THIS AGREEMENT WILL BE THE SUBSTITUTION OR REPLACEMENT OF ALL OR PART OF THE SITE THAT GIVES RISE TO DAMAGES INCURRED BY YOU. YOU AGREE THAT THIS LIMITATION OF LIABILITY WILL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. IN THE EVENT A COURT OF COMPETENT JURISDICTION DETERMINES THAT WE ARE LIABLE FOR DAMAGES OF ANY KIND, YOU AGREE THAT SUCH DAMAGES SHALL NOT EXCEED FIVE HUNDRED DOLLARS (US$500).

- Indemnity.
You agree to indemnify and hold GGMI, its affiliates, parents and subsidiaries, and their respective agents, officers, directors, or other employees, harmless against all losses, claims, demands, damages (whether direct, indirect, or consequential, including reasonable attorneys’ fees), made by anyone in connection with or arising out of or relating to your use of the Site, your breach of this Agreement, or your violation of any laws or the rights of third parties with respect to the Site or Content. - Minors.
The consent of a parent, guardian or educational supervisor shall be required before a Minor can use the Site. Use of any part of the Site is confirmation that the person is an adult or a Minor who has received permission from a parent, guardian or educational supervisor to use the Site. A parent, guardian or educational supervisor will be responsible for any activities of a Minor on the Site regardless of whether the Minor has received permission from the parent, guardian or educational supervisor to use the Site. - Claims of Copyright Infringement.
We rely on our users to bring copyright infringement to our attention. This Agreement will be governed and construed in accordance with the laws of the United States. Use of the Site is not authorized in any jurisdiction that does not give effect to all provisions of this Agreement. - Third Party Software.

Our failure to act with respect to a breach by you or others does not constitute a waiver of our right to act with respect to subsequent or similar breaches. We provide this Privacy Statement to highlight our policy with regard to the information we gather through your use of this Site. This Privacy Statement does not apply to the practices of companies that GGMI does not own or control, or to people that it does not employ or manage. The policies contained in this Privacy Statement are incorporated by reference into our Terms of Use for the Site.
- GENERAL
In general, you can visit the Site without telling us who you are or revealing any information about yourself.
